Who we are
Nimbu Realty Pty Ltd (ABN 21 664 450 177) is a licensed real estate and business agency (Licence TC 87074) operating from Level 3, 1060 Hay Street, West Perth WA 6005. We trade as Nimbu Realty and, for our commercial property services, Nimbu Commercial. In this policy, we, us and our all mean Nimbu Realty Pty Ltd.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. This policy explains what we collect, why we collect it, who we share it with and how you can access or correct your information.
What we collect
The information we collect depends on how you deal with us. It may include:
- Your name, phone number, email address and postal address.
- Details of property you own, are selling, leasing or looking to buy or rent.
- If you apply for a tenancy: identification, employment and income details, rental history, references and other information needed to assess your application.
- If we act for you in a transaction: financial and legal details needed to complete the sale, lease or management of the property, including bank details for trust account payments.
- Records of our correspondence with you, including enquiries sent through this website.
- Basic website usage information collected through cookies, described further below.
How we collect it
Most information comes directly from you: through the forms on this website, by phone or email, at inspections and home opens, or through a tenancy application. Tenancy applications are submitted through 2Apply, whose own privacy policy also applies to that process.
With your consent, we also collect information from third parties such as referees, employers and previous landlords or agents when assessing an application. In the ordinary course of agency work we obtain property and market information from public registers and industry data services, including Landgate, RPData, Cotality and REIWA, and we receive your details from realestate.com.au or realcommercial.com.au when you enquire on one of our listings through those portals.
Why we collect it
We collect and use personal information to provide our services: appraising, marketing, selling and leasing property, assessing tenancy applications, and managing properties on behalf of their owners, including rent collection, inspections, maintenance and statements. We also use it to respond to your enquiries, to meet our legal and regulatory obligations as a licensed agency (including trust accounting, identity verification and record keeping requirements), and, where you have agreed, to send you market updates and property news. You can opt out of marketing at any time using the unsubscribe link in any email or by contacting us.
Who we share it with
We share personal information only where it is needed to deliver our services or where the law requires it. Depending on the circumstances, that can include:
- Property owners, when you apply for or occupy one of their properties, and prospective buyers or tenants, where transaction details need to be exchanged.
- Tradespeople and contractors arranging maintenance at a managed property.
- The software platforms that run our agency: Reapit (client and property management), 2Apply (tenancy applications) and Xero (accounting).
- Advertising portals when your property is listed, including realestate.com.au and realcommercial.com.au.
- Settlement agents, conveyancers, solicitors, strata managers, financiers and insurers involved in a transaction or managed property.
- Regulators and government bodies where disclosure is required by law, including under real estate licensing and tenancy legislation.
We do not sell personal information to anyone.
Tenancy database
When assessing a tenancy application we may check your details against the National Tenancy Database (NTD), operated by Equifax Australia. In limited circumstances permitted by the Residential Tenancies Act, such as a tenancy ending with unpaid rent beyond the bond or damage beyond the bond, we may also list a tenant on that database. We will tell you before we use the database in relation to your application, and if a listing is ever proposed you will be notified and given the opportunity to respond first. You can contact the NTD directly through equifax.com.au to check or dispute information it holds about you.
Where your information is stored
We use reputable cloud-based platforms to run the agency, and some of these providers store data on servers located outside Australia. Where that occurs, we take reasonable steps to ensure the provider handles personal information to a standard consistent with the Australian Privacy Principles. Access to client information within our agency is limited to the people who need it to do their work, and we retain records only as long as the law and our professional obligations require.
Cookies and analytics
This website uses cookies to help it function and to give us anonymous information about how the site is used. We use Google Analytics for this purpose, which records information such as which pages are visited, for how long, and the general location and device type of visitors. This data does not identify you personally. You can block or delete cookies through your browser settings; the site will still work.
Accessing or correcting your information
You can ask us at any time what personal information we hold about you, and ask us to correct anything that is inaccurate or out of date. Contact us using the details below and we will respond within 30 days. There is no charge for making a request, though for large or complex requests we may recover reasonable retrieval costs, which we would agree with you first.
Complaints
If you believe we have mishandled your personal information, contact us first and we will investigate and respond within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
Changes to this policy
We update this policy from time to time as our services or the law change. The current version is always the one published on this page.
